1. Acceptance of Terms

By accessing and using LumiAfrica's platform, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the terms of this agreement, you are not authorized to use or access the LumiAfrica services.

2. Use License

Permission is granted to temporarily access LumiAfrica's platform for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose or for any public display
• Attempt to reverse engineer any software contained on LumiAfrica's platform
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server

3. User Accounts

When you create an account with us, you guarantee that:

• The information you provide is accurate, complete, and current
• You will maintain and promptly update your account information
• You are legally able to enter into binding contracts
• You will maintain the security of your account credentials
• You are responsible for all activities that occur under your account

4. Products and Services

All products and services are subject to availability. We reserve the right to:

• Limit quantities of any products or services we offer
• Discontinue any product at any time
• Refuse service to anyone for any reason at any time
• Modify product prices and specifications

5. Pricing and Payment

All prices are listed in Kenyan Shillings (KSh) and are subject to change without notice. We accept various payment methods including credit/debit cards, M-Pesa, and other approved payment services. You agree to provide current, complete, and accurate purchase and account information for all purchases made via our platform.

6. Vendor Terms

Vendors using our platform agree to:

• Provide accurate product descriptions and pricing
• Fulfill orders in a timely manner
• Maintain appropriate business licenses and permits
• Comply with all applicable laws and regulations
• Handle customer service inquiries professionally

7. Prohibited Activities

You may not use our platform for any illegal or unauthorized purpose. Prohibited activities include but are not limited to:

• Violating any local, national, or international law
• Transmitting any harmful code or malware
• Engaging in fraudulent activities
• Harassing, abusing, or harming other users
• Impersonating any person or entity
• Collecting user information without consent

8. Intellectual Property

The service and its original content (excluding content provided by users or vendors), features, and functionality are and will remain the exclusive property of LumiAfrica and its licensors. The service is protected by copyright, trademark, and other laws of Kenya and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of LumiAfrica.

9. Limitation of Liability

In no event shall LumiAfrica, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.

10. Modifications to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our service after any revisions become effective, you agree to be bound by the revised terms.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of Kenya.
